Cultivator Liability/Required Disclosure Statement
Cannabis is a Complementary and Alternative Medicine (CAM). California SB 577 Regulations recognize the individuals who provide CAM health care services and products as CAM Practitioners.

The SB 577 Regulations require CAM Practitioners to provide a "Disclosure Statement" regarding their services and qualifications.  The Disclosure Statement is signed by the Patient. The CMCC assists cultivators in writing a CAM Practitioner Disclosure Statement.

Required Physician’s Approval for Patients Medicinal Use of Cannabis
Farmers Market Cultivators are required to obtain a copy of the Patient’s current Physician Approval before providing any products to the patient.

The Physician’s Approval is invalid unless it has been issued within the last twelve (12) months. Patients are required to renew the Physician approval every 12 months.

Random, batch testing, is the way the Department of Cannabis Control tests for the safety of products sold by city and state licensed cannabis retail facilities.

Reasonable Compensation
The cultivator’s reasonable compensation for dried and cured cannabis flowers is the cultivator's wholesale price.

Sales Taxes
Cultivators are required to have a Sellers Permit from the State Board of Equalization.

Patients who have a Department of Public Health (DPH) Medical Marijuana Patient ID Card are exempt from paying Sales Taxes.

Grow Site Compliance
Cultivators agree to cooperate with the CMCC Compliance Committee, to ensure compliance with SEC. 137. Section 11362.765 of the Health and Safety Code.

Product Orders and Sales
All transactions are directly between the Qualified Patient (or Patient's Primary Caregiver) and the cultivator.

Delivery Services
Most cultivators provide Delivery Service.

Complaints/Report Issues
The Website Menu includes a "Report an Issue" button that may be used by qualified patients and cultivators to report an issue or complaint.

The CMCC Patient Services Committee is responsible for documenting and responding to the issue. The CMCC is a Member of the Better Business Bureau and uses the BBB guidelines for processing a complaint.

CMCC Monthly Forum
The CMCC Forum is held on-line on the first Monday of the month at 12:00 pm via Zoom. The meeting agenda includes CMCC Committee reports and recommendations from participating cultivators.
